The Tribunal Superior de Justicia de Madrid (TSJM) has declared the nullity of the Modificación Puntual de Plan General de Ordenación Urbana de Madrid (PGOU) signed by the team of José Luis Martínez-Almeida last February, which involves the transformation of the old garages in the Madrid district of Chamberí into housing, as well as green areas.
This is stated in a sentence, accessed by Europa Press, in which the appeals filed by Ecologistas En Acción Madrid and the Association Madrid Ciudadanía y Patrimonio are considered.
The judges agree with the appellants regarding their criticisms of the «improper» consideration of the alternatives of urban development in their processing and environmental assessment, indicating that a detailed reading shows that «the determinations that should have been fulfilled are not met».

«The proposed alternatives are nothing more than a variable and detailed configuration of the different building structures and the location of the green area and roads,» the Court considers.
Thus, it insists that «there is no environmental analysis process, nor sustainability and improvement of urban quality in the choice, nor among them is there any different option that could give the area a different use than proposed and could also represent that improvement,» the sentence states.
RESPONSE TO 443 FAMILIES
The City Council’s plan addressed the situation of 443 cooperative families who have been waiting for years to have their homes in the Chamberí district.
The area covers an area of 43,253 square meters with a buildable area of 59,586 square meters, allocating 10% of residential building capacity to protected housing.
A little over three months have passed since the votes of PP and Vox approved in the Cibeles Plenary the urban agreement between Residencial Metropolitan Sociedad Cooperativa and Metro de Madrid in the old Cocheras de Cuatro Caminos which, according to the delegate of Urban Planning, Environment and Mobility, Borja Carabante, «is not a windfall», as the left accused, but a solution for «good people».

The first works could start in 2026, provided that there are no judicial appeals.
«They have deeply harmed these 443 families by intentionally delaying their right to access their homes. If they had a little shame, they would look at the faces of the neighbors of Cuatro Caminos, of the 443 families, and see that in their faces there are no vultures or speculators but good families who have been robbed of their right to access the home they bought ten years ago and have not given up,» defended Carabante.
«The cooperative system for building homes is a system that institutions should support, as long as ordinary citizens are behind it,» said Vox councilor Ignacio Ansaldo.
The socialist Antonio Giraldo questioned the cleanliness of the PP’s records while the councilor of Más Madrid Sara Ladra criticized the «purely speculative interest of the PP governments with this plot.»

«INDIGNANT» ATTITUDE
Meanwhile, residents and citizen associations of the Chamberí district have celebrated the sentence and have described it as «outrageous» that the local and regional Administration «express admiration and praise for architect Antonio Palacio, but have been promoters of the destruction of the Metro garages in Cuatro Caminos,» one of his works.
«It was a unique place, with great cultural transmission capacity, with the possibility of being a living museum space, in a network that no other European capital could have,» they defended in a statement.
It was a dream to make it a reality, and the cost was insignificant. There just needed to be political will and less disdain for the activity and public intellectual activism of the citizenry,» they added.

Madrid Ciudadanía y Patrimonio, Ecologistas en Acción, Corazón Verde, and Parque Sí en Chamberí have urged to «restore and return everything to the previous physical and legal situation, incorporating into any future planning the reconstruction of the extension of the nine original warehouses in a sawtooth pattern, as well as the factory warehouse and the two complementary lateral warehouses of the Cuatro Caminos garages.»
